1. Introduction

This Privacy Policy describes how HeyApex, operated by Styley AI Inc. and Media Magic Apps Inc. ("we," "us," "our," or "HeyApex"), collects, uses, discloses, and safeguards information in connection with the HeyApex Platform and Services.

Integrator Disclosure: HeyApex is an integrator, not the provider, of the underlying AI, messaging, and image generation services. Your data may be processed by third-party systems we do not own, operate, or control.

By using the Services, you agree to this Privacy Policy. If you do not agree, do not use the Services. HeyApex may update this Policy at any time; material changes communicated via email, in-app, or posting. Continued use constitutes acceptance.

2. Information We Collect

2.1 Information You Provide

We collect information you voluntarily provide, including:

  • Name, email, phone number, mailing address
  • Company name, business information, professional credentials
  • Real estate license details, mortgage originator license details, and other professional licensing information
  • Payment and billing information (see Section 2.7)
  • Transaction data, lead information, property data, client records
  • Communication preferences, campaign settings, workflow configurations
  • Client Content (marketing materials, images, photographs, trademarks, logos, contact lists, all data you input)
  • AI prompts, inputs, instructions, and preferences
  • Autonomous workflow settings, automation rules, scheduling parameters
  • Feedback, suggestions, feature requests, and other input regarding the Services
  • Information about your fee structure and compensation arrangements with your clients (solely for compliance and platform configuration purposes)

2.2 Automatically Collected Information

  • IP address, browser type, OS, device identifiers
  • Usage data (pages, features, time, clicks)
  • AI interaction logs (prompts, outputs, features, errors)
  • Autonomous workflow activity logs (emails, SMS, social posts, timestamps, engagement)
  • Beta/experimental feature usage data
  • Cookies and tracking technologies (see Section 10)
  • Log data (access times, errors, referring URLs)

2.3 Third-Party Sources

Information from integrations you connect: MLS feeds, CRM platforms, email providers, social media, data aggregators, public records.

2.4 AI-Generated Data

When you use AI features: your inputs are transmitted to third-party AI providers; AI outputs are created and stored; image metadata is logged; interaction metadata collected for QA; and aggregated de-identified data may improve Services.

2.5 Automated Communication Tracking

For emails, SMS, and social posts sent on your behalf: delivery status, engagement data, SMS confirmations, social metrics, and opt-out records are collected for compliance.

2.6 Feedback and Suggestions Data

If you provide feedback, suggestions, ideas, or feature requests, we collect and store this information. You assign all rights in feedback to HeyApex, and we may use it without attribution or compensation.

2.7 Payment Processing

HeyApex does not store full credit card numbers, CVV codes, or complete payment card data. Payment processing is handled by PCI-DSS compliant third-party processors. We receive only limited transaction data necessary to manage your subscription. HeyApex charges on a flat-fee subscription, per-seat, usage-based, or flat-fee outcome basis and does not charge on a percentage or commission basis.

2.8 Biometric Information

HeyApex does not collect, process, store, share, sell, or host biometric information. If this changes, we will update this Policy and obtain required consents, including BIPA compliance.

2.9 Consent and Acceptance Records

We store timestamped records of your acceptance of Terms, privacy consents, and autonomous workflow opt-ins, including user identifier, IP address, version accepted, and date/time.

3. Data Ownership, License, and Content License

All data you upload becomes the property of Styley AI Inc. and Media Magic Apps Inc. You receive a revocable license to use your content within the Services during your subscription, with a 30-day export window on termination.

You also grant HeyApex a worldwide, royalty-free, perpetual, irrevocable license to use, reproduce, modify, and distribute your content for operating, improving, marketing, and promoting the Services, and generating anonymized analytics and benchmarks. This license survives termination.

We do not sell your personal identification information to third parties nor have we done so in the past 12 months under CCPA.

4. How We Use Your Information

We use information to:

  • Operate and maintain all AI-powered features
  • Process AI prompts and outputs; execute autonomous workflows
  • Track communication metrics; process transactions
  • Send notices and support; customize content; analyze usage
  • Detect fraud; maintain CAN-SPAM/TCPA compliance
  • Verify identity and licenses; enforce Terms; comply with law
  • Develop new features; implement feedback
  • Any purpose disclosed at collection or with consent

We do not use your information to participate in, calculate, or receive any commission, referral fee, or transaction-based compensation.

5. AI Training, Third-Party Providers, and Data Processing

5.1 Training Policy

We do not train AI models on your Client Content or personal data except with aggregated de-identified data or explicit consent. We configure providers to opt out of data training.

5.2 Third-Party AI Providers

We use: LLM providers (Anthropic, OpenAI, etc.); image generation services; data enrichment; email/SMS delivery; social media APIs; and analytics services. We maintain data processing agreements with material providers. Providers may change.

5.3 Autonomous Workflow Processing

When autonomous workflows are enabled: content is generated and delivered automatically; recipient data is processed; engagement data collected; opt-outs processed; and analytics generated. You are responsible for contact consent and compliance.

5.4 Beta Feature Data

Data processed through beta, experimental, or early access features may be used for testing, improvement, and development purposes with even broader usage rights than generally available features. Your use of Beta Features constitutes consent to such additional processing.

5.5 High-Risk Use Data Processing

HeyApex does not process data for automated decisions regarding employment, housing, credit, insurance underwriting, or lending. Any unauthorized use for such purposes is conducted solely at your risk. HeyApex disclaims all liability for data processing related to prohibited high-risk uses.

6. SMS Communications and Mobile Opt-In

Third-Party Sharing: We will never share your mobile phone number or SMS opt-in information with third parties for marketing purposes. Your mobile information is used solely by HeyApex to provide you with the services you have subscribed to.

Opt-Out: Text STOP to any message you receive to stop receiving SMS communications. You will receive one final confirmation and will no longer receive messages unless you opt back in.

Message and data rates may apply. Message frequency varies. AI-generated SMS content is subject to all Terms disclaimers.

7. How We Share and Disclose Your Information

We do not sell personal identification information. We may share with:

  • Third-party AI providers, email/SMS/social platforms, vendors and service providers
  • With your consent; in corporate transactions; for legal compliance
  • To enforce Terms; with professional advisors; in de-identified aggregate form

We do not share your information with any third party for the purpose of facilitating, calculating, or paying commissions, referral fees, or transaction-based compensation.

8. Data Security, Shared Responsibility, and Breach

8.1 Security Measures

Encryption in transit and at rest; MFA; regular assessments and pen testing; network monitoring; secure cloud infrastructure; employee training; vendor due diligence; patch management.

8.2 Shared Responsibility

You are responsible for: credentials, configurations, consent collection, monitoring, and incident reporting to security@heyapex.ai.

8.3 Third-Party Disclaimers

As an integrator, we are not responsible for breaches in third-party systems. We maintain DPAs but cannot guarantee third-party performance.

8.4 Breach Notification

HeyApex notifies for breaches of its own systems per applicable law. Third-party breaches are the provider's responsibility. HeyApex cooperates and relays as required by law.

9. Cookies and Tracking Technologies

We use cookies for: sessions, analytics, email tracking, marketing measurement, and fraud detection. Control via browser settings. Opt-out: aboutads.info/choices, networkadvertising.org/choices. We do not respond to DNT signals.

10. Data Retention and Disposal

  • Account data: subscription duration + compliance period
  • AI logs: deleted within 90 days of termination
  • Communication logs: 3-year minimum
  • Opt-out lists: indefinite
  • Consent records: business relationship + statute of limitations
  • Billing: per tax/financial law
  • Feedback: indefinite (assigned to HeyApex)
  • Aggregated data: indefinite

Request deletion at privacy@heyapex.ai, subject to legal retention, 30-day export, and Terms data ownership provisions.

11. Your Privacy Rights

Subject to applicable law and data ownership provisions:

  • Access, portability, deletion, correction, restrict processing
  • Object, opt out of sale (we do not sell), withdraw consent
  • Opt out of automated decision-making

11.1 California (CCPA/CPRA)

Right to know, delete, opt out, limit sensitive data, non-discrimination. Contact privacy@heyapex.ai. Under-18 Californians may request content removal.

12. Limitation of Liability for Data Practices

TOTAL LIABILITY FOR CLAIMS UNDER THIS POLICY SHALL NOT EXCEED THE LESSER OF: (A) AMOUNTS PAID IN THE 30 DAYS PRECEDING THE EVENT, OR (B) $50.00 USD.

13. Compensation and Fee Structure Disclosure

HeyApex's fees are software subscription and usage fees only. HeyApex does not charge on a commission, percentage, or referral fee basis. HeyApex does not participate in or receive any portion of real estate commissions, mortgage origination fees, insurance premiums, or any other transaction-based compensation earned by users.

Data about your professional transactions that you input into the Services is used solely for operating the platform and providing AI-powered features. It is not used to calculate, facilitate, or process commissions or referral fees.

14. Insurance Recommendation

HeyApex recommends that you maintain appropriate professional liability (E&O) and cyber liability insurance for your professional activities, including coverage for technology-assisted content, automated communications, and data processing.

15. Children's Privacy

Not intended for individuals under 18. We do not knowingly collect from children. Contact privacy@heyapex.ai for removal.

16. International Data Transfers

Data processed in the United States using domestic and global infrastructure. Where required (GDPR), we implement appropriate safeguards including SCCs.

Export Controls: By using the Services, you represent that you are not subject to U.S. trade sanctions and your use complies with export control laws.

17. Changes to This Privacy Policy

Material changes communicated via email, in-app, or posting. Continued use constitutes acceptance.
