HeyApex provides paid subscription services for AI-powered lead nurturing, automated drip campaigns, and advanced client management. Paid services require you to sign up for a monthly subscription plan that will automatically renew, with payment in U.S. dollars. Features and pricing are subject to change at HeyApex's sole discretion.
To access or use our Services, you must create an account with us. When you create this account, you must provide accurate and up-to-date information, including your real estate license details and ways to communicate with you about your account. It is important that you maintain and promptly update your details and any other information you provide to us to keep such information current and complete.
You agree that HeyApex provides immediate access to digital services upon completion of your order or purchase, without waiting the 14-day withdrawal period. Therefore, you expressly waive your right to withdraw from this purchase. All sales are final and nonrefundable. HeyApex may issue credits at its sole discretion in the event of issues with your experience that cannot be easily rectified.
Unless otherwise stated, your subscription fees ("Fees") do not include federal, state, local, and foreign taxes, duties, and other similar assessments ("Taxes"). You are responsible for all Taxes associated with your purchase, and we may invoice you for such Taxes.
If any amount of your Fees is past due, we may suspend your access to the Services after providing you written notice of late payment.
HeyApex reserves the right to change its prices at any time. If you are on a subscription plan, changes to pricing will not apply until your next renewal.
It is important that you keep your account password confidential and that you do not disclose it to any third party. You must immediately notify us at support@heyapex.ai if you know or have any reason to suspect that your account or password has been stolen, misappropriated, or otherwise compromised, or in case of any actual or suspected unauthorized use of your account.

You can stop using the Services and cancel your subscription at any time through the website or by emailing us at support@heyapex.ai. If you cancel your subscription, you will not receive a refund or credit for any amounts that have already been billed or paid.

If you believe that any content on the Services has been copied in a way that constitutes copyright infringement, you may submit a notification to our copyright agent in accordance with 17 U.S.C. § 512(c) of the Digital Millennium Copyright Act (the "DMCA").
Notices of copyright infringement claims should be sent by email to legal@heyapex.ai. It is our policy, in appropriate circumstances and at our discretion, to disable or terminate the accounts of users who repeatedly infringe copyrights or intellectual property rights of others.
HeyApex's name, trademarks, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Styley AI Inc. or its affiliates or licensors. Certain features and/or functionality of HeyApex's products, including AI automation algorithms, may be protected by patent applications or patents.
As between you and HeyApex, all content (including AI assistants, automation workflows, and campaign tools), software, text, graphics, illustrations, logos, patents, trademarks, service marks, copyrights, and the "look and feel" of the Services (the "HeyApex Content") are either owned or licensed by HeyApex. Use of the HeyApex Content for any purpose not expressly permitted by these Terms of Use is strictly prohibited.
Subject to these Terms of Use, you are granted a non-exclusive, limited, non-transferable, non-sublicensable, revocable, worldwide license to access and use the Services and HeyApex Content solely for your professional real estate activities, in compliance with these Terms of Use.
By using HeyApex, you agree that the Services are intended solely for licensed real estate professionals to automate lead nurturing, manage client campaigns, and support business operations. You acknowledge that when using client data or third-party information, you must have express permission and comply with privacy laws.
As a condition of use, you promise not to use the Services for any purpose prohibited by these Terms of Use. You may not:

Your access to and use of the Services are at your own risk. The Services are provided "AS IS" and "AS AVAILABLE" with all faults. To the maximum extent permitted by law, HeyApex by Styley AI Inc., its affiliates, officers, directors, employees, agents, partners, suppliers, and licensors (the "Company Entities") disclaim all warranties, express or implied, of merchantability, fitness for a particular purpose, or non-infringement.
The Company Entities make no warranty regarding: (a) the accuracy, timeliness, or reliability of AI-generated content or automation tools; (b) harm from use of the Services; (c) compatibility with systems; (d) uninterrupted access; or (e) deletion of data.
To the extent permitted by law, the Company Entities shall not be liable for any damages, including indirect, incidental, consequential, or punitive damages arising from your use of the Services, even if advised of the possibility. Total liability shall not exceed the lesser of $100 or amounts paid by you in the past 6 months.
You agree to defend, indemnify, and hold the Company Entities harmless from claims arising from: (a) your breach of these Terms or laws; (b) violation of third-party rights; (c) misuse of the Services; (d) your data or campaigns; or (e) your negligence.

Informal Process First: You and HeyApex agree to first attempt to resolve disputes in good faith, allowing 60 days for response.
If unresolved, disputes will be mediated in Montgomery County, Maryland, under Maryland law, using a qualified mediator. Mediation shall not exceed two days unless agreed. Each party bears its own costs.
If mediation fails, claims will be resolved by binding arbitration in Montgomery County, Maryland, administered by JAMS under its rules, using a sole arbitrator. The arbitrator will apply Maryland law. Judgment may be entered in any court with jurisdiction. Arbitrations are individual; class actions are waived.
YOU AND HEYAPEX WAIVE THE RIGHT TO TRIAL BY JURY OR CLASS ACTIONS.

Notice regarding Apple: These Terms are between HeyApex and you; Apple is not a party. The license is limited to personal, non-commercial use on authorized Apple devices, subject to Apple's App Store terms. Apple has no obligation for maintenance or support. Apple is not responsible for claims related to the Services. Apple is a third-party beneficiary.
Google Play: Google Play terms prevail in conflicts. Google has no liability for compliance.
These Terms are the entire agreement and supersede prior communications. If any provision is unenforceable, it will be limited to remain effective. Failure to enforce rights is not a waiver.
